Terms Of Service Agreement

By placing an order with Toro Steel Buildings Ltd. (“Company,” “we,” “us,” or “our”), you (“Customer,” “you”) agree to the following Terms of Service. This agreement outlines our payment policies, chargeback waiver, and order terms.

To proceed with your purchase, you must review and agree to these terms before payment.

1. CHARGEBACK WAIVER & PAYMENT AUTHORIZATION

By submitting payment, you expressly waive your right to dispute charges through a chargeback request with your credit card provider. Instead, all disputes must be handled directly with Toro Steel Buildings Ltd.

By proceeding with your order, you agree that:

    Final Sale: Your purchase is final. You will not dispute or initiate a chargeback for this transaction.

    Custom Order: Steel buildings are custom-fabricated and cannot be canceled, returned, or refunded after order acceptance.
  • 3
    Alternative Dispute Resolution: Any concerns must be addressed directly with Toro Steel Buildings Ltd. before attempting any third-party intervention.

    Credit Card Authorization: If paying by credit card, you confirm that you are the authorized cardholder and explicitly authorize the transaction.
  • 5
    Fraudulent Chargebacks: If a chargeback is initiated against this agreement, Toro Steel Buildings Ltd. reserves the right to pursue legal action to recover funds, including all applicable fees, collection costs, and damages.

2. PAYMENT TERMS

  • A 25% deposit is due at order placement.
  • The remaining balance must be paid 14 days prior to scheduled shipment via Wire Transfer or ACH.
  • Full credit card payments may be permitted on a case-by-case basis but are subject to additional verification steps and authorization.
  • If delivery is delayed due to the customer’s request, final payment is still due on the original scheduled date.

3. ORDER PROCESSING & DELIVERY

  • Orders cannot be canceled after acceptance.
  • The customer is responsible for obtaining necessary permits.
  • Shipping & Freight:

    • We will ship to the nearest accessible location.
    • The customer is responsible for offloading materials from the delivery truck.
    • If offloading takes longer than two hours, the customer will be charged additional fees.

4. CUSTOMER RESPONSIBILITIES

By proceeding with this purchase, you acknowledge that you are responsible for:

  • Ensuring the building meets local zoning and permit requirements.
  • Verifying that the foundation meets structural requirements.
  • Accepting delivery even in the case of disputes regarding quality, condition, or workmanship.
  • Notifying Toro Steel Buildings Ltd. of any missing or damaged components within 60 days of delivery.

5. WARRANTY & LIMITATION OF LIABILITY

  • Toro Steel Buildings Ltd. is not responsible for any damages due to:

    • Improper installation.
    • Acts of nature (wind, snow, flooding, etc.).
    • Customer modifications.
  • Any warranty claims must be submitted directly to the manufacturer.
  • We are not liable for indirect, consequential, or incidental damages.

6. DISPUTE RESOLUTION & GOVERNING LAW

  • All disputes shall be resolved in Toronto, Ontario, Canada.
  • The customer agrees to handle all disputes through arbitration before any legal action is taken.
  • Any legal proceedings must be brought exclusively in the courts of Ontario, Canada.
